Server building terms
We sell Discord server building as a service. These terms govern the rights related to it.
Pricing
The price of server building is provided up front. Before work begins, the customer has to have paid the invoice for the server building. If the sum exceeds 100%, partial payments tied to progress can be negotiated. In these cases we reserve the right to charge for payment fees and administrative overhead.
Scope
The scope of the work and what's included is agreed upon at the beginning with itemised pricing. In case something turns out to not be possible you can either remove it and it won't be made, or a suitable alternative can be discussed. In cases where the alternative would take considerably longer we reserve the right to provide a new quote for the price of the work.
Refunds
If the work hasn't been completed, the customer is provided a partial refund based on the amount of work that has been completed. In these cases we reserve the right to deduct any payment/refund fees or administrative overhead from the refund total.
Cancellation by us
In cases where we have to cancel the project with no fault of the customer, the customer is provided a full refund and gets to keep the work that has been done.
If the customer caused the cancellation, a partial refund based on the work done is provided and the customer gets any work that has been completed. Some causes which we may terminate the contract due to the customer include:
- Repeated lack of communication or long periods of silence (5 business days of not responding.). Usually in these cases the project deadlines are extended and the project is put on hold until the customer responds.
- Harassment of our staff (No refund provided.)
- Suspected illegal use for the server. (No refund provided).
Delivery date
During negotiation a delivery date is set. The deadline of the delivery data is 23.59 GMT+2/GMT+3 of the agreed upon date. (Depending on the current Finish time). The delivery includes a week long grace period in this case.
Acceptable delays
Acceptable delays move the delivery date to the future by the amount that the delay caused. These delays are things which are out of our control and anything which isn't reasonable to account for. Some of these include but are not limited to:
- Natural disasters and other acts of god.
- Power grid outages.
- Other political conflicts.
Customer delays
In cases where the delay is caused by the customer, (for example by not providing specifications, assets or anything else.) the delivery date is moved to the future by the delay amount. In cases where the delay makes it impossible for us to complete the work in time, a new delivery date is set.
Delays beyond the grace period
In case we fail to deliver even after the grace period then the customer can request a full refund. We reserve the right to not deliver the work in this case.
